به گزارش روز پنجشنبه خبرنگار فرهنگی ایرنا، 'پژمان محمدی' در نشست 'بررسی وضعیت قراردادهای نشر و حقوق فعلی و پیش نویس قانون جامع حمایت از حقوق مالكیت ادبی هنری و حقوق مرتبط' در سرای اهل قلم نمایشگاه كتاب افزود: تدوین قانون حمایت از حقوق مالكین و مولفان در صورتی موثر است كه به بهره برداری از این قانون نیز فكر شود.

وی ادامه داد: یكی از روش های حمایت از قانون حمایت از مولفان آثار ادبی، ایجاد چارچوب های مشخص در قرارداد نشر آثار ادبی است.

این استاد دانشگاه تاكید كرد: هدف از شناسایی حقوق مولف احترام به تلاش وی در خلق یك اثر ادبی است و باید بدانیم كه یك مولف از طریق خلق یك اثر ادبی امرار معاش می كند. محمدی توضیح داد: قرارداد نشر باید از حالت شفاهی به مكتوب تغییر پیدا كند زیرا در این صورت قابل استناد بوده و اینگونه به حفظ حقوق مولف كمك می كند.

وی خواستار درج حداقل حقوق مولفان در قرارداد نشر شد و تاكید كرد كه حقوق مالكان نیز بر اساس چنین قراردادی حفظ می شود.

این استاد دانشگاه یادآورشد: قراردادهای نشر باید برای ناشر حق تالیف ایجاد كند و ناشر نیز بر اساس این قرارداد مجاز به بهره برداری از یك اثر ادبی باشد و تعهدات دراین نوع قراردادها دو سویه باشد.

محمدی گفت: نام حقیقی مولف باید در قرارداد نشر درج شود و در هر صورت مولف پاسخگوی تالیف خود باشد و مورد نقد جامعه قرار گیرد.

به گزارش ایرنا، احمد علی محسن زاده نیز در این نشست گفت: نخستین پیش نویس قانون جامع رعایت حقوق مولفان پیشتر به دولت ارایه شد، امیدواریم این لایحه قانونی پس از تصویب در دولت برای تبدیل شدن به قانون به مجلس ارایه شود.

وی افزود: خلا های بسیاری در قانون حمایت از مولفان مصوب سال 48 وجود دارد و تلاش ما است با تدوین قانون جدیدمسایل و مشكلات موجود برای مولفان كاهش یابد.

مدیر كل دفتر حقوقی و مالكیت معنوی وزارت فرهنگ و ارشاد اسلامی یادآور شد: در حوزه جهانی عضو هیچ معاهده جهانی حمایت از حقوق مولفان نیستیم و تلاش بر این است با آماده كردن لایحه جدید قانونی و در عین حال تنظیم پیش نویس پیوستن به كنوانسیون برن و رم خلا های موجود از میان برداشته شود.

محسن زاده تاكید كرد: همچنان منتظریم به موازات پیشرفت تدوین قانون مالكیت معنوی در داخل، موضوع پیوستن به كنواسیون های جهانی نیز پیگیری شود و دراین زمینه به نتایج درستی برسیم.

وی با بیان اینكه قرارداد نشر در كشور باید بازبینی شود توضیح داد: در قانون سال 48 برای مالكیت معنوی مصادیق و ملاك درستی وجود نداشت و به نظر می رسد با تجدید نظر در قرارداد نشر می توان در این زمینه به شفافیت بیشتری رسید.

مدیر كل دفتر حقوقی و مالكیت معنوی وزارت فرهنگ و ارشاد اسلامی یادآور شد: اغلب اختلافات میان ناشران و مولفان به دلیل عدم شفافیت قرارداد نشر است و با ایجاد بندهای مشخص در این قرارداد می توان این مسایل را كاهش داد.

عباس حسینی نیك از حقوقدانان و رییس انتشارات مجد نیز در این نشست گفت: مهم است كه پدید آورنده یك اثر ادبی چه كسی خواهد بود زیرا مولف باید مسوولیت اثر خود را بپذیرد و ناشران توجه داشته باشند كه در قرارداد نشر نام پدید آورنده اثر ذكر شود.
